Terms of Service

The agreement

These Terms of Service are the contract between you and BotKelp for the account, API keys, credits, project linking, and related MCP tools. By creating an account or using those features you agree to them.

Use of the public website itself is also covered by the Website Terms. The Privacy Policy explains how we handle personal data. If the documents conflict on a data-protection point, the Privacy Policy wins.

Eligibility

You must be at least 16 and able to form a contract. If you use BotKelp for an organisation, you confirm you have authority to bind it.

Accounts and keys

You are responsible for the account and for every API key issued to it. Raw keys are shown once. Treat them as secrets. If a key leaks, revoke it from the dashboard.

We may revoke a key or suspend an account if we reasonably believe it is abused, compromised, or used in breach of these terms.

Credits

New accounts receive a starter grant of credits so you can try a credit-gated tool. Extra credits are sold in packs listed on the Account page. Pack contents and prices are those shown at the moment you confirm.

Credits are prepaid digital content. They are applied to the account immediately on confirmation. By confirming a purchase you request that immediate performance and acknowledge that you lose the 14-day consumer withdrawal right for that purchase, except where local law does not allow that waiver.

Credits are consumed when a gated MCP tool accepts a valid key. Unused credits have no cash value and are not transferable. Refunds are given only where the law requires them (for example a faulty charge or a non-waivable consumer right).

Acceptable use

You must not:

• Share a live API key in a public place, or use someone else’s key.
• Probe, overload, or disrupt the website or MCP server beyond normal use.
• Use the service to generate or operate systems that are unlawful, or that violate another person’s rights.
• Misrepresent the source of generated project files.

The registry and generated files

Component manifests and generated files are provided so you can inspect them. Generated source files carry a one-line BotKelp licence mark. Full subscriber licence and policy text is not written into those files; it is returned separately via get_site_profile. Third-party libraries named in a component remain under their own licences.

Service quality

We aim to keep the website and MCP endpoint available, but we do not promise uninterrupted service, particular throughput, or that a given tool run will succeed. Features may change. We will not remove credits from an account except to fulfil a gated tool or to correct an obvious error.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

Subject to that, we are not liable for indirect or consequential loss, lost profits, or loss of data, and our total liability arising out of the service in any twelve-month period is limited to the amount you paid us for credits in that period (or one hundred euro if you paid nothing).

If you are a consumer in the EEA or UK, your statutory rights are not affected.

Ending the account

You can delete your account from the Account page at any time. Remaining credits are then extinguished. We may close an account for material breach, after a reasonable chance to fix it where that is practical.

Law

These terms are governed by Irish law, without regard to conflict-of-law rules. If you are a consumer, mandatory protections in the country where you live still apply, and you may bring proceedings there.

Changes

We may update these terms. The date at the top is the current version. Continued use after a change is acceptance of the new terms. If a change is material we will post a notice on the site.
